Verfahren, das in erster Linie dazu dient, Aufschluss zu erhalten über die sachliche Richtigkeit, die Vollzugstauglichkeit und die Akzeptanz von Vorhaben des Bundes, insbesondere von Vorhaben, die dem Referendum unterstellt sind, wie Verfassungs- und Gesetzesvorlagen und völkerrechtliche Verträge, wobei die interessierten Kreise (namentlich die Kantonsregierungen, politischen Parteien und Verbände) vom Bundesrat zur Stellungnahme (Vernehmlassung) über die Vorhaben eingeladen werden.

Procedure that primarily serves to obtain information on the factual accuracy, feasibility of implementation and the public acceptance of federal proposals, and in particular of proposals that are subject to a referendum such as constitutional amendments, legislative bills and certain international treaties, whereby the interested parties (in particular the cantonal governments, political parties and the associations) are invited by the Federal Council to state their opinions on the proposals.

Procédure qui sert en premier lieu à déterminer si les projets de la Confédération, en particulier les projets soumis au référendum comme les modifications de la Constitution, les projets de loi ou certains traités internationaux, sont matériellement corrects, exécutables et susceptibles d'être bien acceptés, et qui prévoit que le Conseil fédéral invite les milieux intéressés (notamment les gouvernements cantonaux, les partis politiques et les associations) à exprimer leur avis sur ces projets.

Procedura che serve principalmente a fornire informazioni sulla congruità di un progetto della Confederazione, sulla sua attuabilità e sul consenso, applicata in particolare ai progetti che sottostanno a referendum come modifiche costituzionali, progetti di legge e determinati trattati internazionali, con cui il Consiglio federale invita le cerchie interessate (in particolare i governi cantonali, i partiti e le associazioni) a esprimere il proprio parere sul progetto sottoposto.

EXP: im Rahmen des Gesetzgebungsverfahrens wird das Vernehmlassungsverfahren während des Vorverfahrens, vor der Ausarbeitung des Gesetzesentwurfs, durchgeführt und vom Bundesrat eröffnet; für Verordnungen werden die Kantone zur Vernehmlassung eingeladen, falls sie in erheblichem Mass betroffen sind; erarbeitet eine parlamentarische Kommission einen Erlassentwurf, so führt sie das Vernehmlassungsverfahren durch; HIS: 2016 wurde das Anhörungsverfahren durch das von einem Departement oder der Bundeskanzlei eröffnete Vernehmlassungsverfahren ersetzt

EXP: dans le cadre de la procédure législative, la consultation est ouverte par le Conseil fédéral avant l'élaboration du projet de loi; quant aux projets d'ordonnances, les cantons sont consultés lorsqu'ils sont particulièrement concernés; lorsqu'un projet de loi est élaboré par une commission parlementaire, c'est à elle d'ouvrir la procédure de consultation; HIS: depuis 2016, la procédure de consultation ouverte par un département ou par la Chancellerie fédérale se substitue à la procédure d'audition

EXP: nel quadro della procedura legislativa, la procedura di consultazione indetta dal Consiglio federale ha luogo durante la fase preliminare, prima dell'elaborazione del disegno di legge; in caso di progetti di ordinanza i Cantoni sono invitati a esprimersi se sono considerevolmente toccati; se un progetto di legge è elaborato da una commissione parlamentare, spetta alla medesima indire la procedura di consultazione; HIS: dal 2016 la procedura di consultazione indetta dai dipartimenti o dalla Cancelleria federale su progetti di portata minore sostituisce la procedura di indagine conoscitiva
