Nach der erweiterten Zustimmungslösung wird eine fehlende[.] Erklärung [zur Entnahme von Organen, Geweben und Zellen] der verstorbenen Person weder als Ablehnung noch als Zustimmung gewertet, sondern lediglich als Nichterklärung. Deshalb werden in diesem Fall die nächsten Angehörigen angefragt. Diese müssen den mutmasslichen Willen der verstorbenen Person berücksichtigen. Wenn die nächsten Angehörigen einer Entnahme zustimmen, so ist diese zulässig.
