DOM: Arbeitsrecht / Werkvertrag; EXP: der Arbeitnehmer hat Maschinen, Arbeitsgeräte, technische Einrichtungen und Anlagen sowie Fahrzeuge des Arbeitgebers fachgerecht zu bedienen und diese sowie Material, die ihm zur Ausführung der Arbeit zur Verfügung gestellt werden, sorgfältig zu behandeln (a); der Unternehmer ist verpflichtet, das Werk persönlich auszuführen oder unter seiner persönlichen Leitung ausführen zu lassen; er hat in Ermangelung anderweitiger Verabredung oder Übung für die zur Ausführung des Werkes nötigen Hilfsmittel, Werkzeuge und Gerätschaften auf seine Kosten zu sorgen (b)

EXP: the employee must use the employer's machinery, work tools, technical equipment, installations and vehicles in the appropriate manner and treat them and all materials placed at his disposal for the performance of his work with due care (a); the contractor is obliged to carry out the work in person or to have it carried out under his personal supervision, unless the nature of the work is such that his personal involvement is not required; unless otherwise required by agreement or custom, the contractor is obliged to supply the resources, tools and machinery necessary for performance of the work at his own expense (b)

DOM: droit du travail / contrat d'entreprise; EXP: le travailleur doit utiliser selon les règles en la matière les machines, les instruments de travail, les appareils et les installations techniques ainsi que les véhicules de l'employeur, il doit les traiter avec soin, de même que le matériel mis à sa disposition pour l'exécution de son travail (a); l'entrepreneur est tenu d'exécuter l'ouvrage en personne ou de le faire exécuter sous sa direction personnelle; sauf usage ou convention contraire, l'entrepreneur est tenu de se procurer à ses frais les moyens, engins et outils qu'exige l'exécution de l'ouvrage (b)
