Als ausländische offene kollektive Kapitalanlagen gelten: a. Vermögen, die aufgrund eines Fondsvertrags oder eines anderen Vertrags mit ähnlicher Wirkung zum Zweck der kollektiven Kapitalanlage geäufnet wurden und von einer Fondsleitung mit Sitz und Hauptverwaltung im Ausland verwaltet werden; b. Gesellschaften und ähnliche Vermögen mit Sitz und Hauptverwaltung im Ausland, deren Zweck die kollektive Kapitalanlage ist und bei denen die Anlegerinnen und Anleger gegenüber der Gesellschaft selbst oder einer ihr nahe stehenden Gesellschaft einen Rechtsanspruch auf Rückzahlung ihrer Anteile zum Nettoinventarwert haben.

On entend par placements collectifs étrangers ouverts: a. les fortunes constituées aux fins d'un placement collectif sur la base d'un contrat de fonds de placement ou d'un contrat d'un autre type ayant les mêmes effets et qui sont gérées par une direction dont le siège et l'administration principale sont à l'étranger; b. les sociétés et les fortunes analogues dont le siège et l'administration principale sont à l'étranger, qui ont pour but le placement collectif et dont les investisseurs ont droit au remboursement de leurs parts à la valeur nette d'inventaire par la société elle-même ou par une société qui lui est proche.

Si considerano investimenti collettivi di capitale aperti esteri: a. i patrimoni accumulati in vista dell'investimento collettivo di capitale sulla base di un contratto del fondo o di un altro contratto con effetti analoghi e gestiti da una direzione del fondo con sede e amministrazione principale all'estero; b. le società e i patrimoni analoghi con sede e amministrazione principale all'estero il cui scopo è l'investimento collettivo di capitale e nei confronti dei quali o di società a loro vicine gli investitori dispongono del diritto al rimborso delle loro quote al valore netto di inventario.

The following are considered foreign open-ended collective investment schemes: a. Assets that were accumulated on the basis of a fund contract or another agreement with similar effect for the purpose of collective investment and are managed by a fund management company with its registered office and main administrative office abroad; b. Companies and schemes with their registered office and main administrative office located abroad whose purpose is collective capital investment and whose investors have a legal right with regard to the company itself, or with regard to a closely associated company, to the redemption of their units at the net asset value.
