Linguistic Context
On appeal, the court looked at the attestation requirements under Section 9 of the Wills Act 1837. The original version required witnesses to “attest and subscribe” the will in the presence of the testator. It did not use the verb “sign” except in relation to the testator’s signature.
Term Note
‘Attestation’ and ‘attest’ are best reserved for the process of witnessing the signing of a written instrument. An ‘attestation clause’ is a provision at the end of an instrument, e.g. a will, that is signed by the witnesses. The attestation strengthens the presumption that all the statutory requirements for signing the will have been met.
