Linguistic Context
An association agreement is a particular agreement that regulates the participation of a non-member state (third country) in part of an area of activity of an international organisation. The third country does not become a member state of the international organisation concerned. From Switzerland’s point of view, the bilateral agreements relating to Schengen and Dublin take the form of association agreements with the EU. With respect to the further development of the corresponding body of law of the EU, Switzerland has a right of decision-shaping, but not of decision-making. However, it decides whether it wants to adopt new legislative act. The EU also concludes stabilisation and association agreements with candidate countries, by means of which the latter are prepared for accession to the EU. In addition, the EU has also concluded association agreements with various other countries for the purpose of creating free trade zones.

Du point de vue de la Suisse, les \haccords bilatéraux \savec l’UE dans les domaines de Schengen et de Dublin sont des accords d’association. Concernant le développement de l’\hacquis de l’UE\s correspondant, la Suisse a un droit de participation mais pas de droit de codécision. En revanche, elle décide si elle entend ou non reprendre un nouvel acte juridique. De manière analogue, l’UE conclut des accords d’association et de stabilisation avec les Etats candidats à l’adhésion. Ces accords permettent de rapprocher ces Etats de l’UE. En outre, l’UE a passé des accords d’association avec une série d’autres Etats, en particulier en vue de constituer des zones de libre-échange.
