Linguistic Context
A provision of international law is said to be “self-executing” when the rights and duties it establishes are sufficiently precise and clear in their formulation. In this case the provision is directly applicable by domestic courts and authorities. If on the other hand the provision of international law is only “programmatic” in character it must be given concrete shape in the form of national law before it can be applied by the courts or authorities (“non self-executing”).

Eine Völkerrechtsregel ist dann unmittelbar anwendbar (self-executing), wenn sie bezüglich der durch sie festgelegten Rechte und Pflichten genügend bestimmt und klar formuliert ist. In diesem Fall können innerstaatliche Gerichte und Behörden die Regel direkt anwenden. Ist die Völkerrechtsregel hingegen nur programmatischer Natur, so muss sie zuerst innerstaatlich konkretisiert werden, um schliesslich von Gerichten und Behörden direkt angewendet werden zu können (non self-executing).

Una regola di diritto internazionale è applicabile direttamente («self-executing») se è sufficientemente determinata e formulata in modo chiaro per quanto riguarda i diritti e obblighi che stabilisce. In questo caso i tribunali e le autorità nazionali possono applicare direttamente la regola. Se invece è solo di natura programmatica, la regola di diritto internazionale deve dapprima essere concretizzata a livello nazionale per potere essere applicata dai tribunali e dalle autorità («non self-executing»).

Si tel est le cas, les autorités et les tribunaux nationaux peuvent l’appliquer directement. Si par contre la norme en question a seulement un caractère programmatoire, elle devra d’abord être concrétisée dans la législation nationale avant de pouvoir être appliquée par les tribunaux et les autorités (« non self-executing »).
