Renonciation de l'organe chargé de l'administration de la justice pénale à poursuivre l'auteur d'une infraction, à le renvoyer devant le juge ou à lui infliger une peine si la culpabilité de l'auteur et les conséquences de son acte son peu importantes, si l'auteur a réparé le dommage ou accompli tous les efforts que l'on pouvait raisonnablement attendre de lui pour compenser le tort qu'il a causé ou s'il a été atteint directement par les conséquences de son acte au point qu'une peine serait inappropriée.

Rinuncia da parte dell'organo di giustizia penale competente al procedimento penale, al rinvio a giudizio o alla punizione se la colpa e le conseguenze del fatto sono di lieve entità, se l'autore del reato ha risarcito il danno o ha intrapreso tutto quanto si poteva ragionevolmente pretendere da lui per riparare al torto da lui causato o se è stato così duramente colpito dalle conseguenze dirette del suo atto che una pena risulterebbe inappropriata.
