Infraction commise par quiconque, dans le dessein de se soustraire à son devoir de servir, ne participe pas à la journée d'information ou au recrutement, ne se présente pas au service militaire, bien qu'il y ait été convoquée, ou refuse, après être entrée en service, d'exécuter un ordre concernant le service qui lui était adressé.

Reato commesso da chiunque, nell'intenzione di sottrarsi ai suoi doveri del servizio militare, non partecipa alla giornata informativa o al reclutamento, non si presenta a un servizio al quale è convocato o disobbedisce, dopo l'entrata in servizio militare, a un ordine a lui diretto concernente il servizio.
