Infraction contre le patrimoine commise par un débiteur ou par un tiers agissant au profit de celui-ci qui, pour obtenir un sursis concordataire ou l'homologation d'un concordat judiciaire, induit ses créanciers, le commissaire au concordat ou l'autorité compétente en erreur sur sa situation pécuniaire, notamment au moyen d'une comptabilité inexacte ou d'un faux bilan.

Reato contro il patrimonio commesso da un debitore, o da un terzo a vantaggio del debitore, che, allo scopo di ottenere una moratoria o l'omologazione di un concordato giudiziale, induce in errore sulla propria situazione patrimoniale i creditori, il commissario del concordato o l'autorità dei concordati, in modo particolare mediante contabilità inesatta o bilanci falsi.
Description
Offence against property in which a debtor misleads his creditors, the Commissioner, or the debt enforcement authorities, in particular by false accounting or drawing up a false balance sheet, in order to obtain a moratorium of debt enforcement or the approval of a judicial composition agreement, or in which a third party acts in the foregoing manner for the benefit of the debtor.
