Description
Offence against property in which a person who with a view to obtaining services of a financial value and although incapable of making or unwilling to make payment uses a cheque card or credit card or similar means of payment that has been entrusted to him by the issuer thereof and thus causes loss to the issuer, and in which the offender is only punishable where the issuer and the contracting enterprise have taken reasonable measures in order to prevent the abuse of the card.

Infraction contre le patrimoine commise par une personne qui, quoique insolvable ou non disposée à s'acquitter de son dû, obtient des prestations de nature patrimoniale en utilisant une carte-chèque, une carte de crédit ou tout moyen de paiement analogue, portant ainsi atteinte aux intérêts pécuniaires de l'organisme d'émission, mais qui n'est punissable que si l'organisme d'émission et l'entreprise contractuelle ont pris les mesures que l'on pouvait attendre d'eux pour éviter l'abus de la carte.

Reato contro il patrimonio commesso da chiunque, essendo insolvente o non disposto a saldare il dovuto, ottiene prestazioni di natura patrimoniale utilizzando una carta-chèque, una carta di credito o un analogo mezzo di pagamento, cagionando un danno al patrimonio dell'istituto d'emissione, se l'istituto d'emissione e l'impresa contraente hanno preso le misure che si potevano ragionevolmente esigere da loro per evitare l'abuso della carta.
